Terms and Conditions

This document sets out the Terms and Conditions (hereinafter, the “Terms”) governing access to and use of the website azoramind.com and the services offered by Azoramind (hereinafter, “Azoramind”, “we” or “the company”). Accessing the site or hiring our services implies full and unconditional acceptance of these Terms.

1. Company identification

Azoramind is a company dedicated to the design, development and implementation of AI, process automation, Business Intelligence and data architecture solutions, with commercial address in Arequipa, Peru.

2. Purpose

Azoramind offers professional consulting and technology implementation services, including:

  • Custom AI agents.
  • Process automation with n8n and other platforms.
  • Business Intelligence development and implementation.
  • RAG (Retrieval Augmented Generation) systems for document bases.
  • CRM and tailored management tools.
  • Data architecture, engineering and modeling.

The specific scope of each service is detailed in the commercial proposal and/or contract signed with each client.

3. Acceptance of terms

By accessing the website, completing a contact form, requesting a quote or hiring any of our services, the user declares to have read, understood and accepted these Terms. If you disagree with any point, you must refrain from using the site or hiring the services.

4. Use of the website

The user agrees to use the website lawfully and in accordance with these Terms. The following is prohibited:

  • Using the site for illegal, fraudulent or contrary to morality and public order purposes.
  • Attempting to access restricted areas, databases or unauthorized source code.
  • Performing activities that may compromise the security, availability or integrity of the site (DDoS attacks, mass scraping, code injection, etc.).
  • Impersonating other people or businesses.
  • Copying, reproducing or distributing the site's content without express written authorization.

5. Intellectual property

All contents of the website (texts, images, logos, videos, source code, design, trademarks, navigation structure, databases) are the property of Azoramind or its respective owners, and are protected by Peruvian and international intellectual and industrial property laws, in particular Legislative Decree No. 822 (Copyright Law).

The user may view, print or download the content only for personal, non-commercial use. Any other use requires prior written authorization from Azoramind.

6. Hired services

Hiring Azoramind's services is formalized through a commercial proposal accepted in writing (email, digital signature or physical contract), detailing:

  • Service scope and deliverables.
  • Execution timelines.
  • Amount, payment terms and economic conditions.
  • Warranties, post-delivery support and applicable SLAs.
  • Personal data processing (DPA) when applicable.
  • Confidentiality and intellectual property of the deliverables.

Any change to the scope must be agreed in writing by both parties and may imply adjustments to timelines and costs.

7. Prices and billing

Service prices are detailed in the corresponding commercial proposal and may be expressed in Peruvian Soles (PEN), US Dollars (USD) or Euros (EUR). Prices include or exclude IGV (VAT) as expressly indicated. Azoramind will issue payment receipts (electronic invoices or boletas) in accordance with Peru's tax regulations.

8. Warranties

Azoramind guarantees that services will be provided with the highest level of professional diligence, under the quality and security standards applicable to the industry. However, we do not guarantee specific outcomes when they depend on external factors such as the quality of the client's data, the availability of third-party services (APIs, AI models, cloud providers) or regulatory changes.

9. Limitation of liability

To the maximum extent permitted by Peruvian law, Azoramind shall not be liable for indirect damages, lost profits, data loss, business interruption or consequential damages arising from the use of the website or services, except in cases of duly proven willful misconduct or gross negligence.

Azoramind's total liability for any claim arising from a specific contract shall not in any case exceed the amount effectively paid by the client for the service subject to the claim in the preceding 12 months.

10. Confidentiality

Azoramind commits to keeping in strict confidence all commercial, technical or strategic information received from the client during the provision of services, unless such information is in the public domain or its disclosure is required by a competent authority. This obligation continues during and after the commercial relationship.

11. Links to third-party sites

The site may contain links to third-party websites. Azoramind is not responsible for the content, privacy policies, commercial practices or services offered by these third parties. Access to such sites is at the user's sole responsibility.

12. Consumer protection

Users acting as final consumers are protected by the Consumer Protection and Defense Code (Law No. 29571) and may file complaints or grievances through our virtual Complaints Book.

13. Personal data protection

The processing of personal data collected through the site is governed by our Privacy Policy, in compliance with Peru's Law No. 29733.

14. Changes

Azoramind reserves the right to modify these Terms at any time. Changes will take effect upon publication on the website. We recommend reviewing this page periodically.

15. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute arising from their interpretation or fulfillment will be resolved, in the first instance, through direct and good-faith negotiation between the parties. If direct negotiation fails, the parties submit to the jurisdiction of the courts of Arequipa, Peru, with express waiver of any other forum that might apply.
